By downloading, installing, or using the FitScan iOS application, the FitScan Chrome extension, or the website at fitscan.io (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service.
FitScan is operated by Gregory Dich (sole proprietor), Brodetsky St 36, Tel Aviv 6905155, Israel ("we", "our", "us"). It provides an AI-powered shoe-sizing platform that converts foot measurements into brand-specific size recommendations across 139 partner brands.
You may use the Service if you are at least 13 years of age. If you are between 13 and 18, you may use the Service only with the involvement of a parent or guardian. By using the Service you represent that you meet these requirements.
Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to install and use the Service for your personal, non-commercial purposes.

FitScan recommendations are guidance, not guarantees. Shoe fit depends on many factors beyond foot length and width — including last shape, materials, sock thickness, time of day, and personal preference. Always check the brand's own size chart, return policy, and your own comfort before final purchase.
FitScan uses verified manufacturer size charts where available and Brannock-style formulas otherwise. We continuously calibrate our algorithms with anonymised user feedback. Individual fit varies. We are not liable for purchases that do not fit; please rely on the seller's return policy for unsuitable items.
FitScan can be used without registration. If you choose to save your Size Passport via email, you grant us a limited license to store and retrieve those measurements on your behalf. You may delete your data at any time through the Delete My Data page.
Your privacy is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Service you also agree to the Privacy Policy.
FitScan integrates with partner shoe stores via our widget and Chrome extension. When you view sizing on a partner store, FitScan provides only the recommended size for that brand — we do not transmit your raw measurements to the store.
Footwear purchases are transactions between you and the partner store. FitScan is not a party to those transactions and is not responsible for product quality, fulfilment, returns, refunds, payment, taxes, or any related obligation. Partner-store terms and policies apply to those purchases.
If you submit feedback on a sizing recommendation (e.g. "fit was too tight"), you grant FitScan a non-exclusive, royalty-free, perpetual license to use that feedback in aggregated, anonymised form to improve the sizing algorithm and to publish industry-level insights (e.g. "average return rate by foot type").
You retain ownership of all content you submit. You agree not to submit content that is unlawful, harassing, or infringes on the rights of others.
FitScan offers a free tier with full sizing access. Optional paid tiers (Starter, Pro, Business) unlock advanced features including 3D Preview, AR Try-On, ROI dashboards and API access. Pricing and feature lists are at fitscan.io/shops.
Paid plans are billed monthly via the platform on which you subscribed (Apple App Store, Shopify Billing API, or BlueSnap). Cancellations take effect at the end of the current billing cycle. Refunds follow the policy of the underlying billing platform.
The Service, its content, design, source code, and trademarks are the exclusive property of FitScan and protected by copyright and trademark law. Brand names, logos, and size charts of third-party shoe brands referenced in FitScan are the property of their respective owners and are used for the purpose of size conversion only.
The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that recommendations will perfectly match every individual's preferences.
To the maximum extent permitted by law, FitScan shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation loss of profits, data, or use, arising out of or related to your use of or inability to use the Service.
Our total cumulative liability to you for all claims arising from or related to the Service shall not exceed the greater of (a) the amount you paid us for the Service in the 12 months preceding the claim, or (b) USD 100.
You agree to defend, indemnify, and hold harmless FitScan and its affiliates from any claim, demand, or damages, including reasonable attorneys' fees, arising out of your breach of these Terms or your misuse of the Service.
We may suspend or terminate your access to the Service at any time, with or without notice, for conduct that we believe violates these Terms or is harmful to other users, to us, or to third parties. You may stop using the Service and request data deletion at any time.
These Terms are governed by the laws of the State of Israel, without regard to its conflict-of-law provisions. Any dispute arising out of or related to these Terms shall be resolved in the competent courts of Tel Aviv, Israel.
If you are a consumer in the European Union, the United Kingdom, or another jurisdiction with mandatory consumer-protection laws, those laws apply to the extent they grant you greater rights than these Terms.
We may revise these Terms periodically. We will post the updated Terms on this page and update the "Effective date" above. Your continued use of the Service after the updated Terms take effect constitutes acceptance of the changes. If you do not agree, please discontinue use of the Service.
